Warranty and Replacement

This page explains the guarantee that applies to products bought directly from bricomexor.com, and how to ask for a repair or a replacement. It is drafted in accordance with Articles 128 to 135-septies of Italian Legislative Decree 206/2005 (Consumer Code), as amended by Legislative Decree 170/2021 implementing Directive (EU) 2019/771, and forms an integral part of the Terms and Conditions.

1. Legal guarantee of conformity

Every product sold to a Consumer is covered by the legal guarantee of conformity. The seller is liable for any lack of conformity that exists at the time of delivery and becomes apparent within two years of that date.

This guarantee is provided by law, is free of charge, and cannot be excluded or limited by contract. It is separate from, and additional to, any commercial warranty offered by the manufacturer.

For Professionals (purchases made with a VAT number), the rules of the Italian Civil Code on sale apply instead: defects must be reported within 8 days of discovery and the action lapses one year after delivery.

2. What counts as a lack of conformity

A product is not in conformity if, among other things, it does not correspond to the description, type, quantity or quality agreed, is not fit for the purpose for which goods of the same type are normally used, does not have the qualities the seller presented as a sample or model, or is not delivered with the accessories, instructions or updates the Consumer could reasonably expect.

A lack of conformity resulting from incorrect installation is treated as a lack of conformity of the goods where installation was carried out by the seller, or where installation by the Consumer was due to shortcomings in the instructions.

The guarantee does not cover damage caused by improper use, negligence, accident, unauthorised modification or repair, normal wear of consumable parts (blades, bits, brushes, batteries beyond their expected cycle life, filters, seals), or failure to follow the manufacturer’s instructions.

3. Presumption in your favour

Any lack of conformity that becomes apparent within one year of delivery is presumed to have existed at the time of delivery, unless the contrary is proved or unless this presumption is incompatible with the nature of the goods or with the nature of the lack of conformity. In practice, in the first twelve months you do not have to prove that the fault was already there.

4. No obligation to report within two months

Since the 2021 reform, there is no longer a duty to notify the lack of conformity within two months of discovery. You can make a claim at any time within the two-year period. That said, telling us early helps us resolve the matter faster.

5. Your remedies, in order

First tier — restoring conformity, free of charge:

  • repair, or
  • replacement.

You may choose between the two, unless the remedy you chose is impossible or would impose costs on the seller that are disproportionate compared with the alternative, taking into account the value the goods would have without the defect, the significance of the lack of conformity and whether the alternative remedy could be provided without significant inconvenience.

Repair or replacement is carried out free of charge — including shipping, labour and materials — within a reasonable time from the request and without significant inconvenience to you, taking account of the nature of the goods and the purpose for which you acquired them.

Second tier — price reduction or termination:

You may ask for a proportionate reduction of the price, or terminate the contract and obtain a refund, where:

  • the seller has not carried out the repair or replacement, or has refused to do so, or has done so with significant inconvenience or beyond a reasonable time;
  • a lack of conformity appears again despite the seller’s attempt to restore conformity;
  • the lack of conformity is so serious as to justify immediate price reduction or termination;
  • the seller has declared, or it is clear from the circumstances, that conformity will not be restored within a reasonable time or without significant inconvenience.

Termination is not available where the lack of conformity is only minor. Where you terminate, you return the goods at our expense and we refund the price within 14 days of receiving them or of proof of dispatch.

6. Time limit for bringing an action

The action to enforce a lack of conformity that was not maliciously concealed by the seller lapses 26 months from delivery of the goods. You may in any case raise the guarantee as a defence to a claim for payment, provided the lack of conformity was notified within 26 months of delivery.

7. How to request a repair or replacement

  1. Write to info@bricomexor.com with the subject line “Warranty claim”.
  2. Include: order number, date of delivery, product name, a description of the fault, and photographs or a short video where the fault is visible.
  3. We reply within 3 working days with an assessment and, where a return is needed, the return instructions and a prepaid label.
  4. Send the product back only after receiving those instructions, packed so as to avoid damage in transit. Return shipping for a valid warranty claim is at our expense.
  5. Once we receive the product we check it and, where the claim is founded, repair or replace it. If the same model is no longer available we will offer an equivalent product or, where you prefer, a refund.

Keep the purchase document (invoice, receipt or order confirmation email): it establishes the date of delivery from which the guarantee runs.

8. Commercial warranty from the manufacturer

Some products carry an additional commercial warranty from the manufacturer, with its own duration, territorial scope and conditions, stated in the warranty statement supplied with the product. That warranty is binding on whoever offers it, on the terms set out in the warranty statement and in the associated advertising.

A commercial warranty never reduces or replaces the two-year legal guarantee of conformity, which you can always enforce directly against us as the seller.

9. Products bought from third-party shops

If you bought the product from another shop after following an affiliate link on this website, the seller is that shop and any warranty claim must be addressed to them.
